TERMS AND CONDITIONS OF PARTICIPATION AND DATA PROTECTION INSTITUT ALLERGOSAN

The organiser of the sweepstakes isInstitut AllergoSan Pharmazeutische Produkte Forschungs- und Vertriebs GmbH, Gmeinstraße 13, A-8055 Graz, Austria (hereafter referred to as "Institut AllergoSan”).

The Institut AllergoSan online sweepstakes is open to natural persons aged 18 or over and resident in Austria, Belgium, Cyprus, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Monaco, Montenegro, the Netherlands, Norway, Portugal, Slovakia, Spain, Sweden, the United Kingdom or Cyprus. (Hereinafter referred to as "Participants"), excluding employees of Institut AllergoSan.

Participation in the sweepstakes is free of charge and participants can choose to enter exclusively by clicking the link sent to subscribers of the AllergoSan newsletter.

To participate successfully in the sweepstakes, participants must fulfil the following requirements: (1) their e-mail address is the recipient of the AllergoSan newsletter at the time of participation, (2) they must click on the entry link in the above-mentioned e-mail and send their entry details before the closing date and (3) they must provide full contact details (first name, last name, address, and e-mail address).

By participating in the sweepstakes, the participant confirms his/her agreement with these terms and conditions.

Only those participants who have fulfilled all the above requirements before the closing date and time will be considered in the draw for the winner.

The respective prize will be awarded by a drawing on 15. 03. 2023. Participation is only possible during the sweepstakes period. The entry link can only be used once per e-mail address.

Prize

There is one of five main prizes to be won in the form of a year's supply of an OMNi-BiOTiC® product of the respective winner's choice. The main prize winners are the persons selected in the prize draw on 15. 03. 2023. Winners will be notified their prize via the e-mail address they provided when entering the sweepstakes and they can then send an e-mail back regarding the OMNi-BiOTiC® product chosen for the year’s supply prize. If they do not confirm their choice of an OMNi-BiOTiC® product within four weeks of being notified of their prize by e-mail, the prize will be forfeited without replacement and will not be allocated to any other participant.

All participants who do not win the main prize will receive a one-time discount code worth 5€ (approx. £4.30) for their next purchase in the online shop https://shop.omni-biotic.com/.

The prizes will be sent to the address provided by the respective winners. The announcement of the winner is made without liability. Redemption for cash or transfer of the prizes is not possible. Legal action is excluded. Any taxes, duties and travel expenses shall be borne by the winner.

Institut AllergoSan acts in accordance with data protection regulations. The data will be processed in accordance with the law and will not be passed on to third parties. The participant agrees to the storage of the data for the purpose of carrying out this sweepstakes. Participants who do not provide the above information in full to Institut AllergoSan will not take part in the sweepstakes. Participants also agree to receive e-mails from Institut AllergoSan in connection with this sweepstakes.

Closing date

Only those participants who have fulfilled the conditions of participation and data protection, and those who have submitted the correct required contact details to Institut AllergoSan, will be considered when drawing the winners. The use of different names or e-mail accounts by one and the same participant is not permitted. Violations of this rule may result in exclusion from the sweepstakes.

 

Exclusion from the sweepstakes

Prohibited content from participants will be removed without notice. Institut AllergoSan is entitled to exclude these participants from participation and reserves the right to take legal action. If the conditions for exclusion are met, prizes may also be subsequently withdrawn or reclaimed. Exclusion for justified reasons shall not give rise to any claims by excluded participants against Institut AllergoSan.

Subject to change

Institut AllergoSan reserves the right to change the conditions of participation at any time or to pause or terminate the sweepstakes or the draw in whole or in part without stating reasons and without prior notice (e.g., in the event of technical faults, for legal reasons, in the event of misuse) if proper processing cannot be guaranteed. Institut AllergoSan is not liable for force majeure, the constant accessibility of the sweepstakes site or for other technical malfunctions. Should individual provisions of these conditions of participation be or become invalid, this shall not affect the legal validity of the remaining conditions of participation. They shall be replaced by a provision that comes closest to the purpose of the invalid provision.

Applicable law and Jurisdiction

To the extent permitted by law, Austrian law shall apply to the exclusion of conflict-of-laws rules. The place of jurisdiction is Graz, district of Puntigam, Austria.

In accordance with the coupling prohibition under EU law, my consent shall only be deemed (and separately) as express consent to receiving the electronic mail if the separately implemented "double-opt-in" function is activated by the corresponding tick in the consent to the processing of data for the purpose of newsletter registration box.
